1. Introduction
Welcome to Mulligans, the marketplace for buying and selling new and pre-owned golf clubs, accessories, and related goods.
These Terms of Service (“Terms”) form a binding agreement between you (“User”, “you”) and Mulligans Golf Ltd (“Mulligans”, “we”, “us”, “our”) regarding your use of our website, mobile app, and all associated services (“Services”).
By using Mulligans, you agree to these Terms and our Privacy Policy, Seller Policy, Buyer Protection Policy, Prohibited Items Policy, and any other rules we publish.
If you do not agree, you must not use our Services.
2. Who We Are
Mulligans provides an online marketplace environment where private individuals (C2C) and registered businesses (B2C) can list, discover, buy and sell goods.
We do not own or inspect items listed on the platform.
Unless explicitly stated (e.g., a Mulligans-managed fulfilment service), we are not a party to the contract of sale between Buyers and Sellers.
3. Eligibility
To use Mulligans, you must:
Be at least 18 years old (or age of majority in your country);
Have capacity to enter a binding contract;
Reside in a country where Mulligans operates;
Comply with local laws relating to selling goods online.
Business Sellers must comply with all applicable consumer protection laws, including returns, cancellation rights, and business identification requirements.
4. Creating and Managing Your Account
To buy or sell on Mulligans, you must register an account.
You agree to:
Provide accurate, complete information;
Keep your login details confidential;
Not impersonate any person or use false information;
Notify us if you suspect unauthorised access.
We may verify your identity using trusted third-party providers.
We may suspend or terminate accounts for breach, fraud, misuse, illegal behaviour, or failure to complete verification when required.
5. Listing Items
When listing an item, you agree to:
Provide accurate descriptions, including defects, wear, and authenticity;
Upload original photos of the actual item;
Ensure you have legal ownership and the right to sell;
Avoid listing items prohibited by law or by our Prohibited Items Policy.
Mulligans may edit, hide, or remove listings that violate policies or create risk.
6. Buying and Selling
6.1 Contracts Between Users
When a Buyer purchases an item using the Mulligans checkout, a legally binding contract is formed directly between Buyer and Seller.
Mulligans is not responsible for the fulfilment of this contract unless stated otherwise.
6.2 Payments
Payments are processed securely via authorised payment providers (e.g. Stripe, PayPal).
Mulligans never stores full card or bank details.
All fees (service fees, seller fees, shipping, promotion fees) are shown prior to purchase.
6.3 Shipping & Delivery
Sellers must dispatch orders promptly using appropriate packaging.
Tracked delivery is required when specified by Mulligans.
Buyers must confirm receipt or report issues within the stated claim window (see Buyer Protection Policy).
When using Mulligans shipping labels or integrated carriers, both parties agree to follow carrier terms and instructions.
7. Buyer Protection
Mulligans provides Buyer Protection for eligible purchases made through the in-app checkout.
Buyer Protection may cover:
Items not received;
Items significantly not as described (SNAD);
Items damaged in transit.
Buyers must report issues within the deadlines specified in the Buyer Protection Policy.
Mulligans may temporarily hold funds in escrow while investigating disputes.
8. Fees and Payouts
Mulligans may charge fees for certain Services, including transaction fees, service fees, or promotion fees.
These will be clearly displayed before use.
Sellers receive payouts once orders are confirmed as completed, subject to:
Verification checks;
Fraud or risk assessments;
Holds required by payment processors or by law.
All payouts are handled via regulated payment institutions compliant with PSD2.
9. Returns, Refunds & Consumer Rights
Private Sellers (C2C)
There is no automatic right of return unless:
The item is Significantly Not As Described, or
The Seller has expressly offered returns.
Business Sellers (B2C)
Business Sellers must comply with all consumer law obligations, including:
A 14-day cancellation right (UK/EU Consumer Contracts Regulations);
Clear disclosure of business identity;
Instructions for exercising cancellation rights;
Processing refunds promptly using the original payment method.
Mulligans may require Business Sellers to provide required legal disclosures when listing.
10. Content and Intellectual Property
Users keep ownership of content they upload but grant Mulligans a non-exclusive, worldwide, royalty-free, transferable licence to use, host, display, modify, distribute, and promote the content for purposes of operating and marketing the platform.
You must not upload:
Copyrighted or infringing content;
Misleading information;
Obscene, offensive, or harmful content.
Mulligans’ trademarks, designs, software code, and platform content remain our exclusive intellectual property.
11. Data Protection & Privacy
Your personal data is processed in accordance with the UK GDPR and EU GDPR.
Please review our Privacy Policy to understand how we collect, use, store, and share your data.
Mulligans acts as:
Data Controller for your account and platform usage information;
Not the controller of your payment data — payment processors act independently.
12. Prohibited Conduct
You agree not to:
Sell counterfeit, stolen, illegal, or unsafe goods;
Engage in harassment, fraud, or abusive behaviour;
Manipulate reviews or feedback;
Circumvent Mulligans fees or conduct off-platform transactions;
Upload malware, spam, or attempt to compromise the platform;
Interfere with other Users or with Mulligans operations.
Mulligans may take necessary action including suspension, removal of content, and legal reporting.
13. Liability & Indemnity
To the fullest extent permitted by law:
Mulligans is not liable for the quality, safety, legality, or accuracy of items listed by Users;
We exclude all implied warranties;
We are not responsible for indirect, incidental, or consequential losses.
Our total liability to any User will not exceed the total fees paid by that User in the previous 12 months.
You agree to indemnify Mulligans for losses arising from your breach of these Terms, misuse of the Services, or violation of any laws.
14. Suspension and Termination
We may suspend or restrict access to your account if you:
Breach these Terms or any policy;
Engage in fraud, illegal activity, or harmful behaviour;
Provide false, misleading, or incomplete information.
You may close your account at any time.
Certain information (e.g., transaction history) may be retained where legally required.
15. Changes to Terms
We may update these Terms from time to time.
Material changes will be communicated via email, in-app notification, or prominent notice on our website.
Continued use of the Services indicates acceptance of updated Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of England and Wales.
Users within the EU retain the protections of their local consumer law.
Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales unless local consumer laws require otherwise.

Account & Data Deletion
To request deletion of your Mulligans account and all associated data, email [email protected] with the subject line "Delete My Account". We will process your request within 30 days.
Data deleted includes your profile information, listings, messages, order history, and uploaded images. Transaction records may be retained for up to 6 years to comply with UK financial record-keeping requirements.
You can also request partial data deletion (e.g. message history only) without deleting your full account.
